This document describes how COLMINK works in relation to your data and your use of the service.
COLMINK gives your business a public page and turns the orders your customers start there into clear, structured messages that arrive in your WhatsApp. It is a tool for organising orders. It is not a marketplace, it does not sell your products, and it is not a party to the sale between you and your customer.
COLMINK does not process payments between you and your customer, does not hold their money, does not deliver goods and does not guarantee any sale. Payment and delivery are agreed directly between you and the person buying from you. Order values shown in the platform are estimates of orders started, never confirmed sales.
You need an account to create a store. Keep your password to yourself and tell us promptly if you believe someone else has access. You are responsible for what happens through your account, including anything done by administrators or operators you invite. You must be at least 18 years old and able to enter contracts to open an account.
Your products, prices, descriptions, photographs and messages are yours, and you remain responsible for them: that they are lawful, accurate, that you have the right to publish them, and that you meet the obligations you owe your own customers, including consumer, tax and product-safety law where you operate. You grant COLMINK only the permission needed to host and display that content on your store and, if you take part, in COLMINK Explore.
Everything published through COLMINK must follow our Acceptable Use Policy. COLMINK may review, investigate, restrict, hide or remove content — and, in serious cases, suspend a store — to enforce these terms and our policies, to protect the safety of people, to comply with the law, and to protect the platform and its users. Enforcement is a decision made by a person, recorded with its reason; no automated signal and no volume of reports changes your content by itself. When your content is affected we tell you what was affected and on what ground, and you may appeal the decision through your dashboard. We never disclose the identity of a person who reported content.
Your store's public address is always www.colmink.com/youraddress and stays the same on every plan. Paid plans let you hide the COLMINK brand from your store pages, and higher plans also from the order messages; that does not change the address and does not transfer ownership of the domain, which remains COLMINK's.
Paid plans are prepaid for the period you choose and do not renew automatically unless you enable that and the payment method supports it. The price you see at checkout is the price charged, in the currency shown, taxes included. A payment receipt is issued for every approved payment; it is proof of payment, not a tax invoice.
Moving to a higher plan takes effect immediately and replaces the remainder of the old plan. Moving to a lower plan is scheduled: nothing is charged at that moment, you keep the current plan until the end of the period already paid, and renewing then costs the lower plan's own price. Because paid periods are prepaid and start immediately, payments already made are non-refundable except where the law grants you a right we cannot exclude.
When a paid period ends without renewal, the store moves to the Free plan. Nothing is deleted: products beyond the Free limits stop being shown publicly and reappear exactly as they were if you upgrade again.
We work to keep the service available and to warn you before planned interruptions, but we do not promise uninterrupted service. Maintenance, provider failures and events outside our control can interrupt it.
You may delete your account at any time from your account settings. We may suspend or end an account that breaks these terms or the Acceptable Use Policy, or where the law requires it. When an account is erased, records we must keep for accounting or legal reasons are retained separately for the period the law requires, and nothing else is kept.
COLMINK is provided as it is. To the extent the law allows, we are not responsible for lost profits or for disputes between you and your customers. Nothing here limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.
COLMINK may use artificial-intelligence-assisted or generative tools in the creation of certain visual, design, marketing or supporting materials used by the platform. This does not apply to content you upload: your store's photographs, descriptions and other material remain yours and your responsibility under these terms.
We may update these terms; material changes are communicated with reasonable notice and, where the law requires it, we will ask you to accept them again. These terms are governed by the law of applicable law, without affecting the mandatory protections of the country where you live.
